Terms of Service

These Terms of Service ("Terms") apply to Pinnie.com, Pinnie-branded websites, online forms, scheduling tools, communications, and related administrative or technology services (the "Services"). The Services are operated or supported by Recora, Inc. (the "MSO").

Clinical services are provided by Pinnie Medical Group, P.C. and, in the future, may be provided by other Pinnie-branded professional corporations or professional medical entities that are formed, licensed or registered where required, and adopt the Pinnie model (collectively, the "Pinnie Clinical Practices").

By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

The MSO provides non-clinical management, administrative, technology, billing-support, care-coordination support, and related MSO services to the Pinnie Clinical Practices. The MSO does not practice medicine, diagnose, prescribe, order clinical services, make treatment decisions, or control clinical judgment.

The applicable Pinnie Clinical Practice and its licensed clinicians are responsible for clinical services, medical records, clinical decision-making, and professional obligations. The MSO may support the Practices as a business associate and administrative services provider.

The Services may support care navigation, Community Health Integration (CHI), Principal Illness Navigation (PIN), care management, telehealth visits, cardiac rehabilitation, pulmonary rehabilitation, remote patient education and monitoring support, resource navigation, scheduling, patient communications, documentation support, billing support, and related services. Cardiac rehabilitation or pulmonary rehabilitation services may be delivered by a Pinnie Clinical Practice through telehealth, hybrid, or other care models where permitted by federal and state law, professional standards, payer rules, and the clinical judgment of the applicable clinician. The availability, scope, and coverage of services may vary by state, payer, clinician licensure, eligibility, medical necessity, and program requirements.

Pinnie.com may advertise and provide educational information to Medicare beneficiaries. Pinnie is not a Medicare Advantage plan, Part D plan, health insurance plan, Medicare broker, enrollment agent, or government website. Pinnie is not endorsed by Medicare, CMS, or HHS. Medicare coverage and cost-sharing depend on applicable Medicare rules and your individual circumstances.

The Services are not for medical emergencies, urgent symptoms, or safety emergencies. If you believe you may have a medical emergency, call 911 or seek emergency care immediately. Do not wait for a response from Pinnie, the MSO, an Advocate, or a clinician through the Services.

Using Pinnie.com, viewing website content, submitting a form, or communicating with the MSO does not by itself create a provider-patient relationship with the MSO or any Pinnie Clinical Practice. A provider-patient relationship may be formed with the applicable Pinnie Clinical Practice or clinician when that clinician or Practice accepts responsibility for providing clinical services to you, including through an initiating visit, assessment, telehealth encounter, care plan, or other clinical interaction.

Information on Pinnie.com is for general informational purposes and is not medical advice. Do not disregard professional medical advice or delay seeking care because of information available through the Services.

The Services may connect you with Pinnie Advocates, care coordinators, and other auxiliary personnel who support care navigation, resource linkage, scheduling, approved patient education, records retrieval, follow-up, and related non-clinical or care-management support.

When services are furnished as CHI, PIN, or similar care-management or navigation services, Advocates and auxiliary personnel furnish those services under the general supervision, protocols, and care plan of the applicable billing practitioner or Pinnie Clinical Practice, as required by law and payer rules. Advocates do not independently diagnose, prescribe, interpret test results, change treatment plans, make clinical decisions, bill Medicare, or supervise other auxiliary personnel.

You agree to provide accurate and complete information and to update it as needed. You are responsible for maintaining the confidentiality of any account credentials and for activity under your account. Notify us promptly if you believe your account or information has been compromised.

We may decline, suspend, or terminate access to non-emergency Services if information is inaccurate, eligibility cannot be confirmed, services are unavailable in your state, telehealth or cardiac rehabilitation services are not appropriate or permitted for your circumstances, you misuse the Services, or continued participation is not appropriate under applicable law, clinical judgment, payer rules, or program requirements.

You agree that the MSO, the Pinnie Clinical Practices, clinicians, Advocates, and service providers may contact you by phone, text message, email, secure message, mail, or similar methods for scheduling, care coordination, administrative, billing, service-related, and legally required purposes. Standard message and data rates may apply. You may opt out of non-essential text messages by following the instructions in the message.

Email and text messages may not always be secure. Do not use email, text, website forms, or portal messages for emergencies.

The applicable Pinnie Clinical Practice or billing practitioner may bill Medicare, Medicaid, a health plan, another payer, or you for covered services where permitted. You may be responsible for applicable deductibles, coinsurance, copayments, non-covered services, or other cost-sharing amounts. The MSO does not bill for clinical services as a medical provider, but may provide administrative billing-support services on behalf of the applicable Pinnie Clinical Practice where permitted.

Coverage is not guaranteed. Medicare and other payers may deny or limit coverage based on their rules, your eligibility, documentation, medical necessity, frequency limitations, place-of-service or telehealth requirements, cardiac rehabilitation or pulmonary rehabilitation program requirements, or other requirements.

Your information is handled as described in the Pinnie.com Privacy Policy and, for PHI maintained by a Pinnie Clinical Practice, the Pinnie HIPAA Notice of Privacy Practices. If there is a conflict between these Terms and the HIPAA Notice regarding PHI, the HIPAA Notice controls for PHI.

You agree not to misuse the Services. You may not use the Services to submit false information, impersonate another person, interfere with security, attempt unauthorized access, copy or scrape content at scale, introduce malware, harass staff or patients, or use the Services in a way that violates law or infringes another person’s rights.

The Services may include links or referrals to third-party websites, health care providers, health plans, community organizations, transportation, food, housing, benefits, or other resources. These resources are provided for convenience and care coordination. We do not control third-party resources and do not guarantee their availability, eligibility, quality, or outcomes.

The Services, website content, trademarks, logos, designs, software, and related materials are owned by the MSO, the Pinnie Clinical Practices, or their licensors. You may use the Services for your personal, non-commercial care-related purposes. You may not copy, modify, distribute, sell, or create derivative works from the Services except as permitted by law or with written permission.

The non-clinical website, technology, and administrative Services are provided on an "as is" and "as available" basis, except as required by law. We do not guarantee that the Services will be uninterrupted, error-free, secure, or available in every state or at all times.

To the fullest extent permitted by law, the MSO and the Pinnie Clinical Practices disclaim indirect, incidental, special, consequential, exemplary, and punitive damages arising from the non-clinical website or administrative Services. Nothing in these Terms limits any liability or rights that cannot be limited under applicable law, including rights related to clinical care, professional negligence, personal injury, consumer protection, privacy, or other non-waivable rights.

We may update the Services or these Terms from time to time. The updated Terms will be posted on Pinnie.com with a new effective date. Continued use of the Services after the updated Terms are posted means you accept the updated Terms, except where additional notice or consent is required by law.

These Terms are governed by the laws of the State of New York, except to the extent the laws of your state of residence or the state in which clinical services are furnished provide non-waivable rights or protections. Clinical services may also be subject to the professional, telehealth, corporate-practice, medical-record, and patient-protection laws of the state where services are furnished or where the patient is located.
